Civil Litigation

The lawyers at Evans & Evans have considerable experience in civil litigation, both at the trial level and at the appellate level. Arbitration

Our firm arbitrates matters for our clients. Many contracts with banks, automobile dealers, contractors, subcontractors, insurance companies, and the like contain arbitration provisions. These contracts require that parties arbitrate their dispute rather than engaging in litigation.

 

Appellate Litigation

Evans & Evans lawyers have represented clients in over 150 cases in the state and federal appellate courts. These cases cover a diverse range of cases including general damage claims, insurance coverage questions, estate and trust matters, construction disputes, land use controversies, and eminent domain cases.

Lawyers in our firm have substantial experience in real estate transactions and litigation. We do all types of contract review, preparation and negotiation in connection with purchases and sales, due diligence, development, construction, and disposition. A significant amount of our representation involves governmental regulation including, zoning and subdivision regulation, impact fees, permitting, environmental regulation, and licensing.

The lawyers at Evans & Evans have a great deal of experience in handling title insurance claims, including coverage questions, direct actions against insurers, and insured representation. Our partners have been retained as litigation consultants on many occasions.

Governmental agencies and other entities having the power of eminent domain often take private property for public uses through the condemnation procedure. When this happens, a landowner is constitutionally entitled to just compensation. Evans & Evans lawyers routinely appear in the courts protecting these valuable landowner rights.
